New Smoke Alarm Law Effective Jan. 1

As of January 1, 2014. All new smoke alarms are required to have the date of manufacture on the alarm and must have a battery capable of lasting 10 years. Most of these alarms will have a 10 year battery installed during manufacture which cannot be accessed. So after 10 years the entire alarm will need replacement. The amount and placement of smoke alarms must be per current standards even in older homes if $1000. or more of upgrades have been done to the home.

Good Neighbor Fence Act of 2013

The Good Neighbor Fence of 2013, effective Jan 1 repeals the previous Civil Code and is updated to read:

  • Adjoining landowners shall share equally in the responsibility for maintaining the boundaries and monuments between them.
  • A landowner intending to incur costs for a fence shall give the adjoining landowner 30 days’ prior written notice to each affecting landowner.

Non-permitted Modifications

CREIA members in Orange County reported that several cities are skimming the MLS and taking notes on properties that have been modified without permits. Once the property in question closes escrow, the city then sends a code official to the door and tells the new owner to “pay up”. An inspection done 6 weeks ago by a CREIA inspector had a detached garage which was converted into living space without permits. The day after escrow closed the city gave the new owner 15 days to comply with current codes.

It behooves all inspectors to write defensive reports regarding unpermitted additions and we should all make our clients aware of the issues which may arise from purchasing properties with unpermitted additions.

New Format for License Number Disclosure

There has been a recent change to the license disclosure format.  Recently, you were told that the Department of Real Estate was changed to the Bureau of Real Estate, and you were asked to format your license number in this manner. CA BRE# 012345678. We have recently learned that BRE® is a registered trademark of CB Commercial. Consequently, we have been instructed to no longer use BRE®. You may exhaust your current inventory of marketing materials with the old format but, effective immediately on all new orders, please use the new format for license number disclosure, which is:  CalBRE# 012345678  (Capital “C”, lower-case “a” and “l” plus capital BRE; all one acronym). All other rules for licensing disclosure still apply.
